London – 4 November, 2021. As previously announced, on October 5, 2021, as part of the implementation of Markel CATCo's proposed buy- out transaction, the joint provisional liquidators (as authorized foreign representatives) of CATCo Reinsurance Opportunities Fund Ltd., Markel CATCo Reinsurance Fund Ltd., Markel CATCo Investment Management Ltd. and Markel CATCo Re Ltd. (the CATCo Group Companies) filed verified petitions under chapter 15 of the U.S. Bankruptcy Code in the U.S. Bankruptcy Court for the Southern District of New York for each of the CATCo Group Companies (Case No. 21-11733 (LGB)). The chapter 15 petitions seek, among other things, recognition of the CATCo Group Companies' provisional liquidation proceedings pending before the Supreme Court of Bermuda, the related proposed schemes of arrangement and further related relief, to ensure that these proceedings are given full force and effect in the United States.

 

Today a hearing was held before Judge Beckerman in the United States Bankruptcy Court for the Southern District of New York to consider the chapter 15 recognition petitions. No objections were filed and Judge Beckerman granted the relief as requested and has entered an order which provides for (i) recognition of the Bermuda proceedings as the foreign main proceedings, (ii) enforcement of the automatic stay in the territorial jurisdiction of the United States and (iii) recognition of the JPLs as the representatives of the CATCo Group Companies in the chapter 15 cases with full authority to administer the group's assets in the United States. The recognition order extends the moratorium on claims against the CATCo Group Companies to the United States and further aids the implementation of the proposed buy-out transaction.
